The following terms and conditions apply to all members and non-member participants and guests in relation to all of their dealings with Volenti Academy. Please ensure that you read all the information thoroughly. The word ‘you’ refers to all players, parents, guardians and guests involved in activities provided by Volenti Academy and may be taken in the singular or plural context.

General

We intend to rely on these terms and conditions to govern the service that we provide to you. We recognise that you may receive verbal information from members of staff but that shall not be incorporated into these terms and conditions which may only be changed by formal, written amendment signed by a director. We will give you reasonable notice of any such changes via a posting on the website or social media. If we consider the changes to be particularly significant, we may also notify you by email. These terms and conditions shall be governed by, and interpreted in accordance with, the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

Payment & Cancellation

We will require payment for your chosen programme in advance of the first session of that programme taking place. We reserve the right to cancel training in circumstances where it may be necessary to ensure the safety of all participants. If this happens, we will arrange an alternative session to compensate. We reserve also the right also to exclude from the programme without refund participants whose behaviour we consider to be unacceptable.

Data and personal information

We will hold your data and personal information in a secure system and in accordance with our privacy policy. We will retain all personal information given to us electronically or on paper to use for registration purposes and to send you emails with news of our activities. We will only share your data with a third party if you have given your permission.

Protection of your privacy

All players are required to register with a member of staff when arriving for training. Players under the age of 12 must be collected from the side of the pitch once the session is over. If you wish to make alternative arrangements for your child, you must inform Volenti Academy staff supervising the session or your child will not be permitted to leave unless collected by the named parent or primary carer. Photographs or video recordings must not be taken at our training sessions, games or events unless we have directly authorised it and it is in accordance with our Safeguarding Children policy. If authorised, photographs and video recordings may be used for marketing purposes but only with the prior written consent of the child’s parent or primary carer.

Physical condition

In registering with us, you are confirming to us that your child is in good physical condition and that you are not aware of any medical or other reason why your child should not engage in exercise. You are also confirming that exercise would not be detrimental to your child’s health, safety, comfort or welfare. Any injuries or medical conditions, current or subsequent, which may affect your child’s ability to perform or participate in our training programmes must be brought to our attention. This is essential to enable us to carry out a risk assessment prior to further participation. All medical information disclosed to us will be held in the strictest confidence.

Our duty

We acknowledge and understand that we have a duty of care to all children and young people, playing or otherwise, who participate in our training programmes. Before and during these activities, risk assessments will be carried out to minimise the risk of harm to all participants and staff. We shall not be responsible for any failure to discharge our obligations where this results from circumstances beyond our control. We do not seek to avoid liability for negligence occasioning death or physical injury but otherwise our maximum liability for any breach of contract or other claim in law shall be limited to a refund of unexpired session fees.

Declaration

In subscribing to a programme with the Volenti Academy, both I (as parent, guardian or primary carer) and my child who will be attending, acknowledge:-

1. I am aware of the potential risks associated with physical exercise and agree to my child voluntarily joining in with these activities in the belief that they are fit to do so.
2. I will notify Volenti Academy immediately of any change in my child’s medical condition.
3 . Volenti Academy accepts no liability for loss or injury of whatsoever nature and howsoever arising caused to me/my child or suffered by me/my child whilst under the care of Volenti Academy unless such loss or injury is caused by the negligent action of Volenti Academy.
4 . I have provided the player registration details to the best of my knowledge, information and belief.
5 . I have read, understand and accept the terms and conditions, including the code of conduct, of Volenti Academy and agree to be bound by them. I understand that Volenti Academy may from time to time make changes.
